Abstract

The paper analyzes the legal nature of the Italian Social Republic. The aim of the contribution is to demonstrate how the violation of constitutional legality prodottasi following the "coup" by King Vittorio Emanuele III July 25, 1943, has formed the basis for the birth of the fascist republican state in September of the same year, after the liberation of Mussolini from captivity on the Gran Sasso of Italy.
