Abstract

This work studies the Simon Bolivar´s political project in Peru and the elaboration of the Constitution of 1826 called life constitution which was a copy of the Bolivarian Constitution imposed by Bolivar in the electoral schools where simply, obeyed the order. This Constitution did not achieve real recognition, neither had real force.  It was lacked of political legitimacy because of ideological reasons and for lacking of national feeling. Likewise, this constitution did not answer to the needs and aspirations of Peru. For those reasons, its norms were ephemeral and its institutions were not reflected in the historical Constitution of Peru.

Valentín Paniagua Corazao (+), Universidad Católica del Perú

Catedrático de Derecho Constitucional, Instituciones Políticas del Perú y Derecho Administrativo en las universidades Católica del Perú, Mayor de San Marcos, y Femenina del Sagrado Corazón. Escribió numerosos trabajos sobre la historia constitucional del Perú y comparada. Entre los más importantes destacan los siguientes: Constitucionalismo, Autocracia y Militarismo (1998); Reelección presidencial y Constitución histórica (2003); La Constitución de 1828 y su proyección en el constitucionalismo peruano (2003); El proceso constituyente y sus principios rectores: Aspectos dogmáticos y particularidades de la Constitución gaditana (2004); y, La evolución del constitucionalismo peruano (2004). Además de su labor intelectual, ejerció la actividad política, siendo dos veces presidente del Congreso de la República (1982 y 2000), Ministro de Justicia y de Educación (1966 y 1984), y Presidente Constitucional de la República (2000-2001).
