Abstract

The Spanish Constitution of Bayona (1808) was the first constitutional code in Spain, even if it is really a Charte Octroyée. Through this Constitution, Napoleon tried to modernize the Spanish Monarchy, and tried to do so introducing the imperial model, that established a system of government where the King was the political centre of the State. Yet the division of powers were a tacit provision of the Constitution, in fact the other branches of government had very limited authority, and they were mainly instruments to support the King.
