Abstract

This essay analyzes the constituent debate of 1828 Constitution of Perú, focusing its constitutional and doctrinal sources, and the discussion about the territorial structure of the country (unitary vs. federalism). Last, it studies the influence of 1828 Constitution over the later constitutionalism of Perú.

Valentín Paniagua Corazao (+), Universidad Católica del Perú

Catedrático de Derecho Constitucional, Instituciones políticas del Perú y Derecho Administrativo en la Pontificia Universidad Católica del Perú. Ha sido profesor en las Universidades de Lima, San Marcos y UNIFE. Ha ocupado cargos públicos, entre los que destaca el de Diputado por Cuzco (1963-1968) y Lima (1980-1985 y 2000), Presidente de la Cámara de Diputados (1982-1983), Presidente del Congreso (2000-2001), Ministro de Justicia (1965-1966) y Educación (1984) y Presidente de la República (2000-2001). Entre sus trabajos más importantes se encuentran: Los orígenes del Gobierno representativo en el Perú. Las elecciones (1809-1826), en prensa; Relaciones Ejecutivo-Legislativo; La Justiciabilidad de los actos Político-Jurisdiccionales del Congreso; Sistema Electoral y Elección del Congreso en Perú.
