The paper analyzes the nature of the Court of Constitutional Guarantees of the Second Republic as a body for the control of constitutionality in the historical context of the First Biennium, revealing the theoretical model finally chosen through the study of the powers of the institution linked to such control. It also investigates the dogmatics of fundamental rights, as well as their protection provided by the Court through the regulatory design of the constitutional complaint. The lack of completeness of the analysis is noted, as it is limited to a historical period in which the Court had not yet come into operation.
