Abstract

This paper analyzes the emergence of parliamentary rules in the modern constitutionalism. We have put special emphasis on the historical and institutional context of the different European legal traditions (Germany, France and England), that allowed the generalization of the parliamentary rules to drive the political process of the representative chambers. In the Spanish case, we have paid special attention to the parliamentary rules of the Courts of Cadiz in 1810, the first formal act which served to recognize, in our constitutional history, those elements that guarantee a model of modern political representation based on national sovereignty.

Josu De Miguel Bárcena, Universidad Autónoma de Barcelona

Profesor de derecho constitucional de la Universitat Autònoma de Barcelona. Licenciado en Ciencias Políticas y Derecho en la Universidad del País Vasco, es doctor por la misma Universidad desde el año 2007. Ha sido investigador  en el Center for Constitutional Studies and Democratic Development de la Universidad de Bolonia – Johns Hopkins University y en la Kansas State Universiy. Su ámbito de trabajo abarca el derecho público de la economía (El gobierno de la economía en la Constitución europea. Crisis e indeterminación institucional, Bosch, 2011), el federalismo (Federalismos del siglo XXI, editado junto al profesor Javier Tajadura Tejada, CEPC, 2014) y el derecho de la comunicación.
