The precedents of the first constitutionalism of Antioquia (Perspective to understand the hispanoamerican constitutional process)

Abstract

In this essay the process of enactment of the Antioquian Constitution of 1812 is analyzed and used as a background to study the 1811-1816 neogranadin constitutional period, that characterized itself by the constant promulgation of constitutional carts. Additionally, this essay studies the influences of the first Antioquian constitucionalism, for this way to comprehend the constitutional process in Hispano-America and the basis of the 'legicentrism–statism' characterizing the legal-political Colombian system along the 19th century.

Andrés Botero Bernal, Universidad Pontificia Bolivariana

Abogado de la Universidad Pontificia Bolivariana; licenciado en Filosofía y Letras de esa misma Universidad; especialista en docencia universitaria de la Universidad Santo Tomás; especialista en contextualización psico–social del crimen de la Universidad de San Buenaventura; diplomado en conformación y gestión de grupos de investigación de la Universidad de Medellín y diplomado en actualidad universitaria de la Asociación de Instituciones de Educación Superior de Antioquia (ASIESDA). Cuenta con un curso de postgrado en ambiente, economía y sociedad, en la FLACSO, Buenos Aires, Argentina. Es Doctorando en Derecho en la Universidad de Huelva, España. Además, es candidato a Doctor en Derecho en la Universidad de Buenos Aires (Argentina). Tiene un Master Europeo Universitario en Storia e comparazione delle istituzioni politiche e giuridiche dei Paesi dell’Europa Mediterranea en las Universidades de Messina (Italia), Milano (Italia), Autónoma de Madrid (España) y Córdoba (España). Actualmente es profesor investigador de la Universidad de Medellín.
