The European dimension of the Spanish Constitutionalism

Abstract

In this essay the complex and varied development of Spanish Constitutionalism is examined (its texts, institutions and doctrines) with the aim to place it in its compared context, mainly the European. Among other considerations the decisive influence of revolutionary France in the Bayonne constitution and in that of Cadiz, the welcoming of English and Post-Napoleonic French Constitutionalism during the Liberal Triennium and the exiles that existed under the absolutism of Fernando VII, the influence of Great Britain and to a lesser extent Belgium and the U.S.A. in Constitutional Spain from 1834 to 1923, the interwar traces of constitutionalism during the Second Republic and finally the European sources, especially German and Italian of the current constitution of 1978 are studied. The international impact of the Cadiz constitution should not be overlooked nor that of the 1931 Constitution.

Joaquín Varela Suanzes-Carpegna, Universidad de Oviedo

Catedrático de Derecho Constitucional de la Universidad de Oviedo y director del Seminario de Historia Constitucional “Martínez Marina”, que edita  “Historia Constitucional” y promueve la editorial digitalIn Itinere. Miembro del Consejo Editorial del Centro de Estudios Políticos y Constitucionales (CEPC), en donde dirige la colección “Clásicos Políticos”, es también codirector de “Fundamentos”. Forma parte del Consejo científico o asesor de varias revistas españolas e italianas. Dentro de sus ciento setenta y cinco publicaciones, algunas traducidas a varias lenguas, destacan sus libros: “Sistema de Gobierno y Partidos Políticos. De Locke a Park (CEPC, 2002, traducido al italiano en 2007), “El Conde de Toreno (1786-1843). Biografía de un Liberal” (Marcial Pons, 2005), “Asturianos en la política española” (KRK, 2006), “Política y Constitución en España. 1808-1978” (CEPC, 2007), “La Constitución de 1876” (Iustel,  2009) y “La Teoría del Estado en las Cortes de Cádiz” (2ª edición, CEPC, 2011). Actualmente dirige la colección “Leyes Políticas Españolas. 1808-1978” y es autor del primero de sus cinco volúmenes: “Constituciones y Leyes Fundamentales” (Iustel, 2012). A finales de 2012 publicará “La monarquía doceañista. 1808-1837. Avatares, encomios y dicterios de una extraña forma de gobierno” (Marcial Pons).
