Abstract

Four years after Marbury, president Thomas Jefferson and his distant cousin John Marshall, then chief justice of the United States, clashed again in United States v. Aaron Burr, a case that took place in the Circuit Court of Virginia. Former Vice-president was charged with treason against the United States.Jefferson wanted a conviction whatever the cost or the means, while Marshall wanted to secure the rule of law and the defendant´s constitutional rights. Important legal questions, like the concept of treason and the extension of executive privilege, arose in this trial.
