This essay try to analyse the political-juridical institute 'estado de sítio', present on the first republican constitution on Brazil. This analysis will focus in legal and historical references, trying to understand the transformations of this period and the influence of this mecanism. One of the central hypothesis is that this mecanism could reveal some important aspects of brazilian governamental praxis on this period.
